Defamation and Defamation Per Se: TMTG asserts that the defendants knowingly spread lies about the company, specifically the $73 million loss, which has harmed TMTG’s reputation and business prospects in Florida, where it is based. TMTG argues that these statements constitute defamation per se because they damage the company's financial reputation
Injurious Falsehood: TMTG accuses the defendants of making false statements that have directly impacted its business, claiming that these assertions were intended to cause harm to TMTG's reputation, financial standing, and its potential merger with DWAC
TMTG claims it has suffered pecuniary losses due to the defendants' accusations, including lost business opportunities and resources spent defending against the false statements
Relief Sought:
TMTG seeks $1.5 billion in compensatory, special, and punitive damages, along with the disgorgement of any income the defendants earned from publishing the alleged lies about TMTG.
TMTG also requests injunctive relief to prohibit further publication of the defamatory statements, payment of legal fees, and any other relief deemed appropriate by the court. Moreover, TMTG demands a trial by jury on all triable issues
